What constitutes a Section 8 Company? A Section 8 Company is a legal entity registered as a Non-Profit Organization (NPO) or Non-Governmental Organization (NGO). These organizations are dedicated to advancing social causes such as arts, education, charity, environmental protection, or scientific research. Profits, if any, or other income must be utilized for these defined purposes, as outlined under Section 8(1a, 1b, 1c) of the Companies Act, 2013.

When registering a Section 8 Company, you don't need to pay stamp duty on the Memorandum of Association (MoA) and Articles of Association (AoA), unlike most other company structures.
Donors to your Section 8 Company can claim tax deductions under sections 12A and 80G of the Income Tax Act.
Registered partnership firms can become members of your Section 8 Company and even hold director positions.
Section 8 Companies don't need to include "Limited" or "Private Limited" in their legal names. You can choose names with terms like "Association," "Society," "Council," or "Foundation."
