Relating to Penalties and Offenses for Non-compliance

The FSSAI has a no-nonsense policy on food production and processing as specified in sections 50 to 65 of the FSSAI, Act 2006. These sections deal with a number of crimes related to food safety issues, making it imperative for people to follow them in order not to face legal repercussions. One of the major offenses would be selling food without having an FSSAI license for which one can face imprisonment along with heavy fines. There are other forms of offenses such as misleading labeling, adulteration of food products, neglecting safety standards, expired products, and so on that are explicitly governed and have penalties. The statutes laid down by FSSAI are entailed in legal obligations and are also very important for the public health that ensures the integrity of any food supply chain.

Selling substandard quality food is an offense under FSSAI regulations and entails a penalty of 5 lakhs.

Misbranded sales attract a penalty of 3 lakhs.

The production, processing, and storage of foods by illegal means incur a penalty of 1 lakh.

The production, processing, and storing of food through unhealthy methods cause a penalty of 1 lakh.

A penalty of 5 lakhs is bestowed if individuals who suffer from it are resulted from the low-quality food.

Failure in remedial action may lead to closure of the business and revocation of license.

Documents Required for New GeM Registration

01Form A:

Fully completed and signed Form A for FSSAI registration.

02Identity Proof:

Copies of identity proof such as Aadhar card, PAN card, Voter ID, or Passport of the proprietor/partner/director.

03Address Proof:

Copies of address proof such as electricity bill, telephone bill, or rent agreement.

04MOA/AOA:

Memorandum and Articles of Association (MOA/AOA) for companies or partnership deed for partnerships.

05Declaration Form:

Declaration form mentioning details of the food business.

06Blueprint/Layout Plan:

Blueprint or layout plan of the premises indicating the different sections such as production area, storage area, etc.

07List of Partners/Directors:

List of partners or directors along with evidence of address and proof of identity.

08Food Safety Management System Plan:

A detailed plan of the Food Safety Management System (FSMS) should be developed as per FSSAI guidelines.

09NOC from Municipality:

No Objection Certificate from the local municipal authority or Panchayat.

10Certificate of Incorporation:

Certificate of incorporation for company; or registration certificate for partnerships.

11Food Category List:

Categories/products of food that would be manufactured or handled.

12Equipment List:

List of equipment and machinery installed for food processing.

13Water Testing Report:

Water testing report from recognized laboratory.

14Proof of Ownership/Rent Agreement:

Proof of ownership of premises or rent agreement.

15Photo ID of Authorized Signatory:

Photo ID proof of the authorized signatory.
