When is a Digital Signature Required?

Company Incorporation

* Company Registration -As far as the purpose of a Digital Signature Certificate is concerned, in essence, the incorporation of any Public Limited Company or a Private Limited Company, a Limited Liability Partnership or even One Person Company will necessitate the use of a Digital Signature Certificate.

Obtaining Director Identification Number (DIN)

* Director Identification Number- A Din number does not come without a Digital Signature Certificate (DSC) attached to it at all especially in the instances of obtaining.

Ministry of Corporate Affairs (Compliances)

* Ministry of Corporate Affairs (Compliances)- When any business incurs more than ninety percent of its gross revenue within one year, a year or less as computed in such years, totaling over sixty lakhs, a Digital Signature Certificate is required to be presented for interposing the returns.

Income Tax

* Income Tax -For the individuals/professionals having gross receipts more than rupees twenty five lakhs, such professional which also include the corporate body having aggregate turnover of one Crore and above rupees, in these cases the income tax to be paid must be filed along with a Digital Signature Certificate.

Goods and Service Tax

* Goods and Service Tax- A business entity other than a Sole Proprietorship must have a Digital Signature Certificate for registrations and while e- filing for GST Returns.

Import & Export Code

* Import And Export Code When any person applies for the import and export code he or she is expected to have a Digital Signature Certificate.

Intellectual Property Rights

* Intellectual Property Rights- When, for instance, applying for a trademark or patent, a Digital Signature Certificate (DSC) has to be provided.

E-Tendering

* E-Tendering- In case of E-Tendering process where the government agencies have provided respective websites, the concerned companies and organization must possess Class 3 Digital Signature Certificate (DSC) to participate or to intend to participate in the process.

Employee Provident Fund

* Employee Provident Fund- Class 3 Digital Signature Certificate may be used by registered Employers in India for submission of their EPF applications.

Who Requires a Digital Signature?

Obtaining a Class 3 Digital Signature is mandatory in the following cases:
  • ➔ E-filing income tax returns for registered trusts, partnership firms, companies, any other entity or individual required for tax audit under the Income Tax Act.
  • ➔ Company filings with the Ministry of Corporate Affairs (MCA21).
